Petition to the Patriarch of Serbia: Defend the right of your congregation to the liturgy

At the same time, Your Holiness, please inform the national authorities that according to art. 202 of the Constitution of the Republic of Serbia, any restriction on the freedom of religion is unconstitutional

Your Holiness,

Bearing in mind today’s decision taken by the government to abolish freedom of movement from 1 p.m. to 5 a.m., we appeal to You, in the name of the Risen Lord Jesus Christ, as the first in the hierarchy of our Holy Church, to demand from the State authorities that the time schedule of the above restriction be adapted to the right of Orthodox believers, who constitute the vast majority of Serbian citizens, to participate in weekly holy liturgies during Holy Week and the Feast of the Resurrection of the Lord.

In presenting this petition to you, first of all, we have in mind the Lord’s commandment on the Holy Mystery of the Eucharist – do this in remembrance of me (Luke 22:19), knowing according to the words of the Holy Apostle, that the Holy Eucharist is served and will be served until the second coming of Christ (1 Cor. 11:26), but also aware that the participation of the faithful people in the Holy Liturgy is necessary, for in the words of St. John Chrysostom “it is not only a priest who brings the blessing, but the whole people.”

At the same time, Your Holiness, please inform the national authorities that according to art. 202 of the Constitution of the Republic of Serbia, any restriction on the freedom of religion is unconstitutional, since in a state of emergency the freedom of religion is enshrined in art. 43. The Constitution has the character of an absolute law. Warn the State authorities that they must not abuse article 43, paragraph 4, of the Constitution of the Republic of Serbia, which provides that exceptionally the law may impose certain restrictions on the freedom of religion. Even then, in accordance with article 18 of the Constitution, it must not affect the substance of the guaranteed right by depriving Orthodox believers of their right to participate in religious worship, in accordance with article 202, in particular, this may not be done by means of decrees, having the force of law, issued during the period of the state of emergency.
